Landlords Beware
New regulations from 06 April 2016 mean owners of tenanted properties need to be aware of changes to the law on recovering possession. The Assured Tenancies and Agricultural Occupancies (Forms) (England) (Amendment) Regulations 2016 has revised the s.8 notice that landlords must serve on tenants when they wish to end the tenancy and recover possession through one of the grounds for eviction set out in the Housing Act 1988 (here think rent arrears). It is essential you use the most recent version of the notice. Failure to do so could will invalidate the notice, meaning any possession claim subsequently filed will fail at Court.
